Custody and Visitation Rights for Grandparents in Texas

Under Texas law, courts can grant grandparents visitation,  under the following circumstances:

  • The parents are divorced
  • The child has been abused or neglected by his or her parents
  • The parent is dead, found incompetent, or in prison or jail
  • The parent-child relationship has been terminated by court order or the child has lived with the grandparents for at least six months
