Texas man in custody case pleads guilty to murdering his children

Child custody disputes sometimes occur in a very emotionally fragile environment, with tension running high. In the majority of cases, conservatorship battles are resolved in a relatively mature and fair way, but there are sometimes cases that tragically tear families apart.

A man in Houston pleaded guilty last week to capital murder for the 2010 shooting of his three children, aged 7 to 14 years old, in their beds. The children were sleeping in his home as part of court-ordered visitation, while he was waging a custody battle with the children’s mother, his estranged wife. He then attempted to take his own life but survived.

His devastated ex-wife described how the man was abusive to her for many years, and she had to escape from the marriage by moving into a shelter. However, she had no option but to hand the children to him for the court-ordered visits, despite keeping written notes about the incidents of abuse.

The man reached a plea bargain agreement with the state, accepting life without parole in exchange for his guilty plea.

Obviously this is an extreme and tragic case of child custody gone very wrong. Most right-minded parents wish to do anything possible to ensure that a custody agreement is reached with the best interests of the children in mind. Gaining an intimate knowledge of family law in Texas is an essential early step toward resolving custody issues with minimum emotional damage to the children involved. Well-honed collaborative negotiation skills are often necessary in order to arrive at an arrangement that is in the best interests of the children.
